This Privacy Policy (“Policy”) explains how TARC Technologies LLC, DBA Travel Advisor Resource Center (TARC) (“Travel Advisor Resource Center”) gathers, uses, discloses, and protects User (“User”) information in relation to the Company websites, browser extensions, mobile applications, mobile websites (“Sites”), and any other associated services that link or refer to this Policy (“Service” or “Services”). By continuing to use our Sites, User hereby acknowledges that User accepts and understands the terms of this Policy. If User chooses to use our Services or Resources, then User agrees to the collection and use of information in relation with this Policy. The Personal Information that we collect may be used for providing and improving the Services and Resources. We will not use or share User information with anyone except as described in this Privacy Policy. If User does not agree to the terms herein, User’s sole remedy is to stop using this Site immediately.

TARC operates the websites: www.traveladvisorresourcecenter.com, www.thetarc.com, www.travelpartnerblog.com, www.travelsupplierdirectory.com, and www.travelpartnerdirectory.com which provides the Services and Resources.

The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which is accessible at www.traveladvisorresourcecenter.com, unless otherwise defined in this Privacy Policy.

Information Collection

How We Collect Data and Information: We use, gather, and process User data whenever User does any of the following: (i) engage with Travel Advisor Resource Center Services; (ii) register to use Travel Advisor Resource Center Services; (iii) access or install Travel Advisor Resource Center Services through Our browser extension, mobile application, or other applications; (iv) reach out to Travel Advisor Resource Center for support; (v) interact with Travel Advisor Resource Center Services through email accounts, business partners, social media accounts, or other third parties; (vi) Respond to a survey or poll; or (vii) enter a contest, promotion, or sweepstakes. As such, Travel Advisor Resource Center is entitled to collect User data when User directly provides certain information, data, or otherwise to Travel Advisor Resource Center. We obtain information and data about User automatically by using “cookies”, log processes, location technology, and other tracking technology when User installs any of Travel Advisor Resource Center’s browser extension, installs any of Travel Advisor Resource Center’s mobile applications, or uses Travel Advisor Resource Center Services online. Third parties may also collect User information and data, including when User connects to Travel Advisor Resource Center Services through a business partner site, third-party service, or other affiliated entity.

Cookies and Types of Data and Information We Collect

Cookies are files with small amounts of data that are commonly used with an anonymous, unique identifier. These are sent to User’s browser from the Site that visited and are stored on User’s computer’s hard drive. Our Sites use these cookies to collect information and to improve our Products and Services. Users have the option to either accept or refuse these cookies, and know when a cookie is being sent to User’s computer. If User chooses to refuse cookies from our Sites, User may not be able to use some portions of our Sites, Products, or Services. *Travel Advisor Resource Center may collect the following types of personal information about User:

Any personally identifying information that User directly supplies to Travel Advisor Resource Center through Travel Advisor Resource Center Services, which may include User’s first and last name, email address, postal address, phone number, and tax information as required for sweepstakes, promotions, or contests;
Any personally identifying information Travel Advisor Resource Center gathers through User’s use of our Services, including IP addresses, device identifiers, system configuration information (including device, session IDs, and operating systems), and any connected hardware information (related to User computer, device, or carrier);
Records of customer information, including payment information like account names, account numbers, and card billing addresses and expiration dates.
Classification characteristics that are protected, including age, gender, marital status, household income, or any other included classification information protected under California law, but only demographic information that User provides in a direct survey response which User can identify;
Commercial information about User’s product or Service purchasing, viewing, clicking, or visiting history in connection with Travel Advisor Resource Center Services, including transaction history, loyalty currency information (such as cash-back), and information relating to merchants, products, and coupons User searched for, viewed, or clicked.
Network and internet activity (for example search history, browsing history, and use of Travel Advisor Resource Center Services), including: (1) anything you search, click, view, and/or otherwise engage with, including those actions conducted on merchant sites visited by way of Travel Advisor Resource Center mobile application; (2) website URLs You visited, including URLs tracked by Travel Advisor Resource Center browser extensions; (3) date and time information related to User searching, browsing, and clicking activity; (4) click stream information, which tracks what User clicks on as User moves from page to page using Travel Advisor Resource Center Services, including any website User visited prior to visiting Travel Advisor Resource Center Sites; and (5) should User choose to sign into Travel Advisor Resource Center Services or create an account for Travel Advisor Resource Center Services through Google or another linked email account, User email Inbox Material.
Location information, including geolocation if User device is set to share it as well as location preferences User provides while using Travel Advisor Resource Center Services;
Audio information, including voice audio recordings from phone calls to Travel Advisor Resource Center as allowable by law; and
Travel Advisor Resource Center own conclusions from the information collected about User, including assumptions regarding User conduct, personal characteristics, preferences, and attitudes.

*All data and information described in this Section shall hereinafter be referred to collectively as “Information”, or “Personal Information.”

Use of Information We Collect

Any Information Travel Advisor Resource Center gathers from or about User may be used for commercial and business purposes, including, but not limited to, the following:

Providing Services and Account Management: Travel Advisor Resource Center is entitled to collect User Information to provide Services and better manager User account, including, but not limited to, purposes such as: (i) ensuring User email address is active and valid, enroll User in Travel Advisor Resource Center Services, and otherwise process User registrations for Travel Advisor Resource Center Services; (ii) track User preferences and transaction history as well as oversee User Services account, such as monitoring User favorite stores, suppliers, affiliates, merchants, and preferred locations as well as User transaction history; (iii) oversee User purchase transactions and/or orders; (iv) provide rewards and/or payments as well as opportunities for rewards and other offers; (v) send relevant messages and updates to User, including those related to security and the management and technical operation of Travel Advisor Resource Center Services, and; (vi) deliver account support and get back to User regarding any requests, inquiries, or comments.
Service Enhancement and Personalization: In order to customize our Services to User preferences to ensure that User experience using our Services is of interest to User, Travel Advisor Resource Center may use User Information to help tailor Services to User specifically. For instance, User purchase or visit history can be used to provide more personalized offers, such as those for stores similar to those User has previously purchased from as well as those we believe may be of interest to User, online or in-store. Any Information Travel Advisor Resource Center gathers about User may also be used to help track tendencies and carry out statistical analyses to help improve Travel Advisor Resource Center Services, including the products and services of affiliates, Travel Suppliers, Travel Providers, business partners, Sites, applications, and marketing efforts.
Marketing: Travel Advisor Resource Center is entitled to use User Information, excluding Inbox Material, to help tailor Travel Advisor Resource Center Services to User, including providing customized offers, discounts, newsletters, reward offers, promotion codes, targeted advertising on third-party websites, Information about Travel Advisor Resource Center Services, as well as offers from merchants and Travel Suppliers, which Travel Advisor Resource Center may communicate to User via email, online advertising, or other means. User is permitted to manage how Travel Advisor Resource Center communicates with User in relation to Travel Advisor Resource Center marketing efforts, such as opting out of specific uses of User Information, specifically for targeted advertising. The terms provided herein are subject to those rights granted to California residents, relating to California residents and opting out of targeted advertising, as discussed in this Policy.
Protection: Any information Travel Advisor Resource Center gathers may be used to look into and minimize fraudulent or malicious activity in Travel Advisor Resource Center Services, enhance Travel Advisor Resource Center security procedures, and evaluate threats or risks. Any Information Travel Advisor Resource Center gathers may also be used in asserting or defending Travel Advisor Resource Center legal rights against outside parties.
Applicable Law Compliance: Any Information Travel Advisor Resource Center gathers may be used to help Travel Advisor Resource Center comply with any applicable laws, rules, regulations, and judicial authorities in every geographic area in which Travel Advisor Resource Center offer our Services.
Sweepstakes, Contests, Surveys, Promotions, and Polls Administration: Should User participate in any of Travel Advisor Resource Center’s sweepstakes, contests, surveys, promotions, or polls, User Information may be used to help carry out such program, including, but not limited to, the determination of eligibility or delivering a reward from such program. Any survey or poll feedback User chooses to provide to Travel Advisor Resource Center will be disassociated with User account and shall be used to help Travel Advisor Resource Center gather Information on developments in shopping trends or other insights.
Log Data: Travel Advisor Resource Center wants to inform User that whenever User visits our Sites or Services, Travel Advisor Resource Center collects information that User’s browser sends to Travel Advisor Resource Center that is called “Log Data.” This Log Data may include information such as User’s computer’s Internet Protocol ("IP") address, browser version, pages of Travel Advisor Resource Center’s Sites and Services that User visits, the time and date of User’s visit, the time spent on those pages, and other statistics.
Referral and Affiliate Program Administration: Should User participate in Travel Advisor Resource Center referral and Affiliate programs, User will provide User referral’s email address so that Travel Advisor Resource Center can invite the referral to use Travel Advisor Resource Center Services by way of email. The Information User provides will only be used to send this invitation and oversee the success of both the Travel Advisor Resource Center referral and affiliate programs. By participating in Travel Advisor Resource Center referral program, User represents and warrants that User is personally associated with the person User is referring and that User is authorized to provide their personal Information to Travel Advisor Resource Center so that Travel Advisor Resource Center can invite them to use Travel Advisor Resource Center Services. If you believe that someone you know has provided Travel Advisor Resource Center with your Information and you do not wish for Travel Advisor Resource Center to have that Information, please reach out to Travel Advisor Resource Center at [email protected] so that we can remove your Information from our system.

Disclosure for Commercial and Business Purposes

We are entitled to disclose Information for commercial and business purposes, including, but not limited to the following parties:

Service Providers: Any User Information Travel Advisor Resource Center gathers may be shared with third parties, including, but not limited to, affiliates, who conduct business for Travel Advisor Resource Center or on our behalf, all in compliance with appropriate security measures to ensure that User Information is protected from any unauthorized use. This includes partnering with third parties to provide User Travel Advisor Resource Center Services and other programs such as support services, payment processing, referral programs, sweepstakes and promotions, surveys and polls, analytics, information base maintenance, authentication services, marketing and communication services, gift card purchasing, product and order fulfillment, reward and payment programs, and the prevention of fraudulent activity on Travel Advisor Resource Center Services.
Business Partners: To better serve our Users and enhance our partnerships, Travel Advisor Resource Center may share User Information, as specified below, with the following third-party business partners:
1. Affiliate Partners. While using our Services, when User accesses a merchant site through a link to purchase another Product or Service, thus indicating that User wants to interact with a business through Travel Advisor Resource Center affiliation, User thus allows Travel Advisor Resource Center to share specific Information about User with an affiliate or Travel Supplier so that Travel Advisor Resource Center can help enhance User purchases. This includes Information that helps Travel Advisor Resource Center track User shopping activity, such as the link User clicked while using Travel Advisor Resource Center Services and any tracking ID assigned to User to verify that User interactions with affiliate merchants came from Travel Advisor Resource Center Services. However, Travel Advisor Resource Center is entitled to disclose Information directly to merchants who do not use an affiliate program as well. Affiliate partners may collect internet and network activity Information, with the exception of Inbox Material, regarding User’s use of Travel Advisor Resource Center Services in relation to their site, products, services, or offers, which may be used either by the affiliate partner or Travel Supplier to track User activity or to develop its own user profiles, or by the affiliate partner’s clients. As such, the disclosure of certain Information to affiliate partners may constitute a “sale” of User Information as defined in the California Consumer Privacy Act of 2018 (“CCPA”). Thus, as described by the terms of this Policy, California consumers may opt-out of allowing this Information disclosure to affiliate partners, except to the extent necessary to carry out Travel Advisor Resource Center Services. If User is a California resident, specifically targeted and personalized offers Travel Advisor Resource Center provides via Services to benefit certain merchants may constitute a “sale” of User personal Information under CCPA, in which case User may opt-out.
2. Referral and Affiliate Marketing Partners. We may share User Information with particular referral and affiliate marketing partners so that Travel Advisor Resource Center can increase the ways in which User is able to learn about and sign up for Travel Advisor Resource Center Services through third-party sites. Travel Advisor Resource Center may also share Information related to User recent purchases or browser extension or mobile application usage with partners in order for affiliate partners to also be able to personalize their site content for User. Again, if User is a California resident, User may opt-out as described in the terms of this Policy, as this disclosure may constitute a “sale” of personal Information under CCPA.
3. Links to Other Sites. Our Sites and Services may contain links to other sites. If User’s click on a third-party link, User’s will be directed to that site. Note that these external sites are not operated by Travel Advisor Resource Center. Therefore, Travel Advisor Resource Center strongly advises Users to review the Privacy Policy of these websites. Travel Advisor Resource Center has no control over, and assumes no responsibility for the content, privacy policies, or practices of any third-party sites or services.
4. Financial Partners. We are entitled to share User Information with financial business partners for the purpose of marketing, which may include other Travel Advisor Resource Center related companies. We are entitled to disclose User Information with financial partners to facilitate transactions if User chooses to purchase additional Products or Services through affiliate partners. We may also disclose User Information to financial partners if User wishes to obtain information from those financial partners so that they can provide that Information to User. Information disclosed to financial partners to aid their marketing efforts may constitute a “sale” of User personal Information under the CCPA. Again, if you are a California resident, User may opt-out of targeted marketing, as discussed in the terms of this Policy.
Digital Advertising Providers: To help advertise and market Travel Advisor Resource Center Services on other websites, third parties may automatically obtain internet and network activity Information relating to User usage of Travel Advisor Resource Center Services, including browsing history, clicked links, and pages visited. This Information, including, but not limited to any Information related to User online activities across different websites, including our Sites, may then also be used by these third parties for their own purposes, such as anticipating User preferences and showing User advertisements displayed by them or other third parties, that may be of interest to User. This Policy, however, does not cover the usage of User Information by third parties. Please visit http://www.aboutads.info/choices/ if User is not interested in allowing User Information to be used for interest-related advertising. Information disclosed with third parties for purposes of targeted advertising may constitute a “sale” of User personal Information under the CCPA. If User is a California resident, User may opt-out of targeted advertising, as discussed in the terms of this Policy.
Other Travel Advisor Resource Center Companies: We work in conjunction with Our closely affiliated companies and businesses and provide User Information for purposes of internal business administration. Of those previously discussed business partners with whom User Information is shared by Travel Advisor Resource Center, some may include Travel Advisor Resource Center associated companies. We are also entitled to share certain personal Information, including, but not limited to, email address, metrics of products, and network and internet activity, excluding any inbox data, with any of Travel Advisor Resource Center’s associated companies or affiliates. Sharing such Information shall be for the purposes of Travel Advisor Resource Center corporate partners and affiliates to monitor and analyze any trends in usage to further improve their website and services, as well as for planning on a strategic level for Travel Advisor Resource Center’s associated companies. To remove User from this form of sharing, User can email [email protected].
Elite Rebate Login Functions: Should Travel Advisor Resource Center, at any time, make available a program that allows User login process to be connected through a single function (ex: single sign-on), by sharing User Information with Travel Advisor Resource Center affiliated companies, User information shall only be shared with such affiliated companies where User so chooses to utilize and connect to this provided function. Upon connecting to an affiliated, User is explicitly authorizing and directing Travel Advisor Resource Center to share User Information with the affiliated company. The Information that shall be shared with such companies includes profile information, such as username, password, and email address, and other necessary payment and identification Information, such as address and first and last name, that may be stored in Travel Advisor Resource Center Sites, Services, or Products through User’s individual sign-up or registration. Should User wish to discontinue the use of Travel Advisor Resource Center single function on any Sites or affiliate partner Sites, User may contact Travel Advisor Resource Center directly at [email protected] for a comprehensive list of all associated Sites and Services that have access to User Information, so that User may contact such Services and Sites directly.

Disclosure for Legal Purposes

Travel Advisor Resource Center is entitled to disclose Information Travel Advisor Resource Center gathers, including personal Information, to the extent permissible under the applicable laws of the relevant jurisdiction, (i) in responding to any legal processes (including subpoenas) or if, in Travel Advisor Resource Center’s good faith opinion, that disclosure is necessitated or allowable by law without a specific disclosure; (ii) in compliance with governmental authorities in the performance of an investigation; (iii) for the enforcement of Travel Advisor Resource Center’s Terms and Conditions or other Service-related policies; and (iv) to protect Travel Advisor Resource Center’s rights, safety, health, security, property, and life or those of any third party.

Disclosure for Transfers of Business Assets

User Information may be disclosed with third parties in connection with or related to any potential or actual acquisition, merger, purchase, sale, including, but not limited to, liquidation, realization, foreclosure, or repossession, or other forms of acquisition of all or any portion of Travel Advisor Resource Center’s assets, as well as the transfer or conveyance of all or a portion of Travel Advisor Resource Center business to another company. In these cases, the involved third-party company is contractually obligated to abide by this Policy as well as any applicable laws in the use of User Information, unless it provides User notice of any new or materially different practices in the use of User information. We also may disclose Information that is not reasonably identifiable as User Information, or that has been aggregated.

Updating Account

In order to ensure that the Information User provides to Travel Advisor Resource Center on Travel Advisor Resource Center Services is accurate, please log into User account to update User Information in the relevant account settings.

Communications Preferences

Email Marketing: User may receive digital and physical mail communication from Travel Advisor Resource Center, such as promotional communications, when User registers for an account through Travel Advisor Resource Center Sites. Should User wish to opt-out of receiving these communications, User is permitted do so by following the instructions provided in those communications, changing User account settings, or contacting Travel Advisor Resource Center directly. If User opts-out of receiving these communications, Travel Advisor Resource Center may still send User communications that are non-promotional in nature, as allowable by law, including communication related to User account, such as order confirmations, payment information, reward updates, client inquiries, or replies to any questions or feedback User submits to Travel Advisor Resource Center, and communication related to Travel Advisor Resource Center continued relationship in the Services Travel Advisor Resource Center provides to User through our Sites.
Mobile Application Notifications: Any of our browser extensions and mobile applications may be configured to User notification preferences in the relevant settings, such as controlling push notifications and alerts.
SMS Messaging: If User provides User’s mobile phone number and agrees to receive mobile messaging, Travel Advisor Resource Center may use SMS messaging to contact User for account and support-related purposes, including account maintenance, customer support, and account recovery updates. User may remove User’s mobile phone number from User account settings or reply STOP to messages received on User’s mobile phone if User wishes to opt out of these messages.
Information Collection and Sharing Preferences: There may be some circumstances in which User is able to refrain from disclosing certain Information to Travel Advisor Resource Center. Your failure to provide Travel Advisor Resource Center with certain Information, however, may affect User’s continued use of Travel Advisor Resource Center’s Services and any related features previously made available to User when such missing information is necessary for the functionality of a part or feature of our Services.
Inbox Linking: If User wishes to unlink User’s email account from Travel Advisor Resource Center Services, User is permitted do so by turning off the connection or updating User email information in User account settings. After User unlinks an email account from Travel Advisor Resource Center Services, Travel Advisor Resource Center will not gather Inbox Material from that account.
Mobile App/Browser Extension: When installed, Travel Advisor Resource Center browser extension and mobile application allows Information relating to User online behavior on the browser or device to be gathered. If User wishes, User may prevent this Information from being gathered by uninstalling the browser extension or mobile application. In some cases, User may be able to opt-out of specific types of Information collection through the browser extension or mobile device Settings.

Notice to Residents of California

This section applies only to residents of California. If User is a California resident, User has specific rights relating to User Information, subject to exceptions, under the California Consumer Privacy Act of 2018 (“CCPA”).

Right to Know and Access: User has the right to know and access User personal Information that Travel Advisor Resource Center has gathered, used, shared for business purposes, and sold during the previous 12 months. This includes source categories from which Travel Advisor Resource Center acquired User Information and the types of third parties with whom we shared User Information for business purposes or to whom we have otherwise sold User Information. User has the right to request in writing from Travel Advisor Resource Center, copies of the following Information Travel Advisor Resource Center gathers that is unique to User: (i) categories of Information Travel Advisor Resource Center gathered about User over the previous 12 months; (ii) the particular personal Information Travel Advisor Resource Center has gathered about User, with the exception of sensitive personal Information Travel Advisor Resource Center may retain in responding to such a request; (iii) the source categories from which Travel Advisor Resource Center acquired User Information; (iv) the purpose of the gathering of such Information about User; (v) the types of third parties to whom Travel Advisor Resource Center disclosed User Information, including whether Travel Advisor Resource Center shared that Information for a business purpose; (v) the categories of Information Travel Advisor Resource Center shared with which third parties; and (vi) whether or not Travel Advisor Resource Center sold User’s Information.
Right to Request Deletion: Subject to specific exceptions, User has the right to ask Travel Advisor Resource Center to remove any Information Travel Advisor Resource Center has gathered from User or keeps about User in Travel Advisor Resource Center’s system. If User asks that Travel Advisor Resource Center remove User personal Information, Travel Advisor Resource Center will do so to the extent that the Information removed is not necessary for business purposes and the Information maintained is done so within Travel Advisor Resource Center’s legal right, in which case User will be informed.
Right to Opt-Out of Sale of Your Personal Information: The sharing of Information about User with merchant partners, third parties, or affiliates for the purpose of providing User benefits and rewards or targeted marketing, may constitute a “sale” of User personal Information under the CCPA to the extent that Travel Advisor Resource Center receive monetary or other consideration for doing so. User has the right to opt-out of the “sale” of User’s Information in this form, by emailing Travel Advisor Resource Center directly at: [email protected]. If User holds a subscription or is a member, User can exercise User Information privacy rights by emailing Travel Advisor Resource Center at [email protected]. Please be aware that Travel Advisor Resource Center may be unable to offer User portions of Travel Advisor Resource Center’s Services which necessitate the sharing of certain Information to the extent User opts-out. Should User have questions, you may reach out to Travel Advisor Resource Center at [email protected].
Right to Non-Discrimination: If User exercises any rights applicable under the CPPA, Travel Advisor Resource Center will not discriminate against User. If User requests to know, access, or remove User’s Information or opt-out of its sale, Travel Advisor Resource Center will not do any of the following, unless otherwise allowed by the CCPA: (i) deny User products or Services; (ii) charge User different prices for products or Services, including the granting of discounts or benefits or imposing penalties of any kind; (iii) give User a different level of quality of Products or Services; or (iv) insinuate that User may receive a different rate, price, or level of quality for Products or Services.
Implementing Your CCPA Rights to Know, Access, and Request Deletion: If User wishes to exercise User’s privacy rights under the CCPA, please email Travel Advisor Resource Center at [email protected], so that Travel Advisor Resource Center can verify User identity. If there is a problem in verifying User identity based on the Information Travel Advisor Resource Center has on file, Travel Advisor Resource Center may ask for further Information for the sole purpose of verifying User identity, maintaining security, or preventing fraud.
Agents: Requests related to User Information can only be made by User or another person legally authorized to act on User’s behalf. In the instance that an agent makes a request on User’s behalf, Travel Advisor Resource Center may require proof from User that the agent is authorized or that the agent has the power of attorney in connection with the request. Additionally, in these circumstances, Travel Advisor Resource Center may require that User independently verify User’s identity.

Note: Travel Advisor Resource Center is not obligated to respond more than twice every calendar year to requests to know or access personal Information.

International Data Notice to Non-US Residents

Our Sites, Products, and Services are located and operated in the United States. Those Users outside of the United States should recognize that the Personal Information collected will be transmitted to the United States from the User’s country of origin. Excluding those Personal Information transfers that are governed by the EU-U.S. Privacy Shield and the Swiss-U.S. Privacy Shield Framework, should User decide to permit Travel Advisor Resource Center to collect User’s Personal Information or provide Travel Advisor Resource Center with User’s Personal Information, such will serve as User’s acceptance and consent of this collected Personal Information being transferred.

Your Rights Under the GDPR

The General Data Protection Regulation (“GDPR”), effective as of 2018, protects the Personal Information of Users located within the European Economic Area (“EEA”), which means they are within the member states and member countries of the European Union (“EU”) at the time of the Site’s use. If User is within the EU, User has the right to certain Information and specific rights under the GDPR. Details on GDPR compliance can be found here. (https://gdpr.eu) Pursuant to the GDPR, those rights include:

Term of Data Maintenance: Travel Advisor Resource Center will keep the Personal Information User has given Travel Advisor Resource Center unless the earlier of: (i.) User asks Travel Advisor Resource Center to delete User’s Personal Information (Art. 17(1) GDPR) or (ii.) Travel Advisor Resource Center concludes Travel Advisor Resource Center does not need User’s Personal Information anymore (Art. 17(1)(a) GDPR) or (iii.) Travel Advisor Resource Center decide the value in retaining the Personal Information is outweighed by the costs of retaining it (Art. 17(1)(c)). Under the GDPR, User is entitled to ask that Travel Advisor Resource Center to delete any or all Personal Information about User in a timely fashion. However, this right may be subject to certain limitations that could result in the termination of User account or restrict User’s access to our Sites, including, but not limited to, (a) when keeping User’s Personal Information may be required by law or required for compliance with certain legal obligations (Art. 17(3)(b) GDPR), (b) where it may be necessary to maintain User’s Personal Information for relevant legal claims or associated defenses (Art. 17(3)(e) GDPR), and (c) where it may be necessary for practicing or exercising a right to freedom of Information and expression (Art. 17(3)(a)) GDPR).
Data Requests and Changes: User has the right to access the Personal Information Travel Advisor Resource Center stores (Art. 15 GDPR), the right to rectify such Personal Information (Art. 16 GDPR), and the right to delete User Personal Information at any time (Art. 17 GDPR). User is entitled to alter the scope of User consent of which Personal Information Travel Advisor Resource Center can retain and how Travel Advisor Resource Center are permitted to use such Personal Information. When exercising this right, it may be necessary for Travel Advisor Resource Center to delete User’s account on our Sites or otherwise limit User access to the features and Content on our Sites. Further, User is entitled to ask for a digital copy of any Personal Information that Travel Advisor Resource Center has about User, free of charge per the first request, and subject to a reasonable fee for any requests beyond the first (Art. 12 GDPR).
Complaints: User can file a complaint to a supervising authority that has jurisdiction over GDPR issues. Subject to having an EU residency, and only in the member state of User’s residence, place of business, or where the alleged wrong has occurred, User is entitled to notify a superior authority of User dissatisfaction should User believe that Travel Advisor Resource Center is using User’s Personal Information improperly or in a way that infringes upon any of User’s rights law or under this Policy. Users that do not reside in the EU are entitled to the rights and protection provided by the relevant jurisdictional laws of their residency (Art. 3 GDPR).
Necessary Information Only: User has the right to provide Travel Advisor Resource Center with only Personal Information that is required to enter a contract and/or transaction with Travel Advisor Resource Center. Travel Advisor Resource Center will not require that User consent to any unnecessary processing as a way to compel User to enter into a contract with Us.
Processing: User can request restrictions on the processing of User’s Personal Information. Further, User has the right to prohibit Travel Advisor Resource Center from processing User’s Personal Information moving forward even if User provided consent to Travel Advisor Resource Center’s processing of User Personal Information; however, past processing of User Personal Information shall not be considered unlawful. User may be entitled to limit the extent of User Personal Information’s processing in appropriate circumstances, including when User has objected to such processing or when User is in the process of rectifying, contesting, or correcting the validity and accuracy of User’s Personal Information. Where User has adequately requested a restriction on the processing of User Personal Information, Travel Advisor Resource Center will no longer transmit User Personal Information to third-party processors unless Travel Advisor Resource Center has obtained User’s consent; this right is limited only by necessity to protect the rights of User, our Sites, or other Users or to comply with legal obligations. However, Travel Advisor Resource Center will continue to store User Personal Information. Though doing so may result in the cancellation of User’s account or further limitations on User’s access to our Sites, User is entitled to restrict processing of User Personal Information by Travel Advisor Resource Center, altogether.
Transfer of Data: User is permitted to assert the right of portability of User’s Personal Information. Unless doing so would subject Travel Advisor Resource Center to unreasonable or undue burden, User is entitled to request that User’s Personal Information be gathered and transferred by Travel Advisor Resource Center, in an interoperable and machine readable format, to another party or controller.
Communications: Travel Advisor Resource Center will only require User’s Personal Information that is reasonably necessary to enter into a contract with Travel Advisor Resource Center. We will not demand that User provide any unnecessary Personal Information as a condition of entering into a contract with Travel Advisor Resource Center.
1. Marketing. User is entitled to request that no third-party communications are transmitted to User and that no third-party marketers have User’s Personal Information for their own marketing purposes. To do so, User may contact Travel Advisor Resource Center at [email protected].
2. Email. User is entitled to request that Travel Advisor Resource Center engage in no further email communications with User. This can be done by selecting the appropriate box upon registration for an account or other engagement with Travel Advisor Resource Center. User is also entitled to alter User’s communication settings at any time by contacting Travel Advisor Resource Center at [email protected].
3. Un-Subscription. If User wishes to unsubscribe from Travel Advisor Resource Center’s emailing list, User is permitted to email Travel Advisor Resource Center at [email protected] and Travel Advisor Resource Center will process User’s request promptly. However, Travel Advisor Resource Center may use the Mailchimp or Hubspot email marketing/management system; therefore, unsubscribing from one list or set of emails might not unsubscribe User from all future emails. Please email Travel Advisor Resource Center at [email protected] if User has any issues unsubscribing and Travel Advisor Resource Center will promptly unsubscribe User.

Our Promise Under the GDPR

To ensure Travel Advisor Resource Center’s compliance with the General Data Protection Regulation (“GDPR”), Travel Advisor Resource Center hereby promises to do the following: (i) comply with all applicable local, state, and federal laws pertaining to the security and furthered protection of User’s Personal Information; (ii) refrain from collecting Personal Information beyond that which is necessary and provided for in this Policy; (iii) process User’s Personal Information transparently, fairly, and legally; (iv) collect Personal Information only for explicit, legitimate, and specific purposes and limit any processing that is unnecessary; (v) where applicable, keep User’s Personal Information confidential, accurate, and up to date to the best of Travel Advisor Resource Center’s reasonable abilities; (vi) effectively monitor and screen employees or independent contractors that may be granted access to User’s Personal Information for reliability and trustworthiness, requiring confidentiality agreements with any employees or independent contractors, and limiting employees and contractors only to those that are reasonably necessary to comply with Travel Advisor Resource Center’s obligations and the law under this Policy; (vii) use reasonable care to protect and secure User’s Personal Information by adding organizational and technical measures to the operation and business of our Sites as necessary; (viii) notify User should Travel Advisor Resource Center receive any legal subpoena or request of access for information that includes User’s Personal Information, (ix) notify User should Travel Advisor Resource Center become aware of any data breach that could have compromised User’s Personal Information’s security and integrity; and (x) observe User’s right to see any of User’s Personal Information that Travel Advisor Resource Center may have collected and rectify, modify, or correct it if necessary, and recognize any further request, within a reasonable time period, to see User’s Personal Information.

The Children’s Online Privacy Protection Act (COPPA)

Under United States federal law, Travel Advisor Resource Center is not permitted to collect any Personal Information or otherwise from children younger than thirteen (13) years of age. Though our Sites are not meant to be used by children younger than thirteen (13), this Policy’s rules apply to children in the United States, so long as they have obtained consent from a parent or guardian. Unless there is parental consent, Travel Advisor Resource Center will not knowingly accept children’s registrations. As a parent of a child younger than thirteen (13), you are required to oversee your child’s usage of our Sites and provide consent if necessary. If User is a child in the United States that is younger than thirteen (13) years of age, please talk to User’s parents or legal guardian before using, or continuing to use, our Sites. Should User have any reason to believe or suspect that another User is under the age of thirteen (13), please notify Travel Advisor Resource Center promptly at [email protected], and Travel Advisor Resource Center will take best efforts to ensure that any Personal Information is removed from our Sites or database. CAN-SPAM ACT OF 2003

The CAN-SPAM Act is a United States law that sets out rules for commercial emails and allows recipients to opt out of unwanted commercial emails and details the consequences for violating the CAN-SPAM Act. Travel Advisor Resource Center complies with the following pursuant to CAN-SPAM Act:

Headers: Travel Advisor Resource Center does not include false or misleading information in Travel Advisor Resource Center’s headers. Travel Advisor Resource Center makes sure there is accurate identifying Information of the person or business who initiated the message.
Subject Lines: Travel Advisor Resource Center does not have deceptive email subject lines. The subject lines in Travel Advisor Resource Center’s emails accurately reflect what is within the email.
Email Advertisement: Travel Advisor Resource Center communicates that any message is an advertisement in a reasonable manner, if such is the case.
Contact Information: All of Travel Advisor Resource Center’s emails will include Travel Advisor Resource Center’s contact Information, including Travel Advisor Resource Center’s physical address, company name, and email address.
Opt-Out: Travel Advisor Resource Center allows Users to opt-out of receiving future emails from Travel Advisor Resource Center. Users are able to unsubscribe from future emails at the bottom of each email and Travel Advisor Resource Center must honor this request within ten (10) business days of the request. Once Users opt-out of receiving emails, Travel Advisor Resource Center is not able sell or transfer the email addresses anymore.
Third-Party Involvement: Travel Advisor Resource Center monitors what is being done with Users’ email Information if a third party is in charge of email marketing. If Travel Advisor Resource Center hires a third-party email marketing company, Travel Advisor Resource Center will keep a close eye to make sure Users’ email Information is being lawfully handled.

Other Notices

Request for Information: California residents are allowed to request specific details about how their User Information is disclosed to third parties for purposes of direct marketing, however, Travel Advisor Resource Center do not disclose your Information to third parties for their own direct marketing purposes.
Do Not Track: Travel Advisor Resource Center does not presently take any action to respond to Do Not Track signals due to the lack of a universally observed and accepted technological standard.
Retention of Information: Travel Advisor Resource Center may retain User Information for as long as necessary to satisfy the purposes discussed in the terms of this Policy. Even after User requests that Information be removed from Travel Advisor Resource Center’s systems, some of User’s Information may be retained for purposes of complying with the law, collecting owed payments, resolving disputes, enforcing legal rights, or for other internal and lawful uses that are reasonably in line with consumer expectations or the situation in which the Information was provided, and to conduct any investigations as may be necessary.
Information Security: In order to protect and secure User’s Personal Information, and to the extent appropriate in light of the risk associated with sharing such Information, Travel Advisor Resource Center has put organizational and technical security measures into place, which are intended to protect Users’ confidentiality and maintain the integrity of such Information. Travel Advisor Resource Center regularly evaluates these measures to ensure that they continue to uphold and apply an appropriate level of security regarding the Information Travel Advisor Resource Center gathers.

This Policy is current as of the effective date provided within this Privacy Policy.
